Terms of Service
In short
- Mia is the platform: it gives you the page, the checkout and the delivery. You are the seller of your products. The contract of sale is between you and your buyer.
- Your Mia subscription starts with 30 free days. You can cancel any time. In the first 14 days after your first payment you get a full refund, no reason needed.
- Buyers' payments go straight into your own Stripe account. Mia takes no commission on sales and holds nobody's money.
- We process your buyers' data only for you, on your instructions (section 14).
- If we have to restrict content or your account, we tell you why and how to appeal.
1. About these terms
These terms are the contract between you and Craftworks Labs S.R.L. ("Mia", "we"), the company that runs Mia at mia.store. Our company details are at the end of this page.
They apply to everyone who uses Mia: creators who build a page and sell through it, buyers who pay on a creator's page, and visitors to the site.
These also form part of the terms: the Acceptable Use Policy, the Refunds and Cancellation Policy, the Privacy Policy and the Cookie Policy.
The Romanian version is the reference version. This English version has the same content and exists to make it easy to read.
2. Words we use
- Creator: the person or business that opens a Mia account to present and sell their products.
- Buyer: a person who buys something from a creator through the creator's page.
- Your page (or your store): the creator's page at mia.store/your-name or on the creator's own domain.
- Product: anything a creator offers through Mia, such as downloadable files, courses, memberships, booked sessions or free materials.
- Mia subscription: the paid plan (Start or Pro) through which a creator uses Mia.
- Consumer: an individual acting outside their trade, business, craft or profession.
3. What Mia does and does not do
Mia is a technical platform. It gives you the tools to sell online: the page, the payment form, delivery of digital products, emails to customers, statistics and, if you want, a connection to your invoicing tool.
When a buyer pays on your page, the contract of sale is between the buyer and you. You are the seller. Mia does not buy or resell your products and is not a party to that contract.
Payment runs through Stripe, straight into the creator's own Stripe account. The buyer's card statement shows your business name. Mia does not receive, hold or move buyers' money.
Mia does not check every product in advance and does not guarantee the quality, lawfulness or delivery of creators' products. We answer for how the platform works, not for what each creator sells.
4. Your account
- To open a creator account you must be at least 18 and fully able to enter into contracts.
- Your account details must be true and up to date. If you act for a business, you confirm you are allowed to represent it.
- Keep your password and sign-in links to yourself. Tell us straight away at support@mia.store if someone uses your account without permission.
- An account belongs to one person or business. You cannot sell or transfer it without our written agreement.
To receive payments from buyers you need a verified Stripe account. Stripe checks your identity when you connect your account and decides on approval. You are the seller and responsible for your own taxes, and fiscal invoices need a PFA or SRL. Without a connected Stripe account you can still use your page, collect subscribers and offer free materials.
5. Your Mia subscription, free trial and payment
Current plans, features and prices are on the pricing page. The price shown when you subscribe applies. Prices in lei include 21% VAT. Prices in euro are shown without VAT, and VAT is added where the law requires it.
- The free trial lasts 30 days on any plan. We ask for your card at the start, but we don't charge you during the trial. We email you before your first payment.
- The first payment is taken on the day the trial ends, unless you cancel before. You can see the exact date on your billing page.
- Renewal is automatic, monthly or yearly as you chose, until you cancel.
- The invoice for your Mia subscription is issued by Craftworks Labs S.R.L. and is in your account.
- If a payment fails, we retry for a few days and email you. If it still fails, your page is paused until you update your card.
Subscription payments are processed by Stripe. Your card details never reach us.
6. Cancellation, withdrawal and refunds
You can cancel any time from Settings → Billing. Your subscription stays active until the end of the period you already paid for. We don't refund the unused part of a period, except under the 14-day rule below or where the law requires it.
14 days after your first payment. For 14 days after your first actual payment (after the trial, or after your first yearly payment) your billing page shows the button "Withdraw from contract here". If you use it and confirm, we refund that payment in full, your subscription closes immediately and you get a confirmation email. We offer this to every creator, consumer or business. You can also withdraw by writing to support@mia.store.
The details are in the Refunds and Cancellation Policy.
7. Conformity of the service (legal guarantee)
If you are a consumer, you have the legal guarantee of conformity for digital content and digital services under Romanian Government Emergency Ordinance (OUG) 141/2021. The Mia subscription is a service supplied continuously, so we are liable for any lack of conformity that appears while you are subscribed.
If the service doesn't work as we described, write to us and we will bring it into conformity within a reasonable time, free of charge. If we can't, you can ask for a proportionate price reduction or end the contract, unless the lack of conformity is minor.
The legal guarantee for creators' products is owed by the creator, as the seller (see section 9 and the Refunds Policy).
8. Changes to prices and features
If we change the price of your subscription, we email you at least 30 days in advance. You can cancel before the new price applies. A promotional or founding price stays locked for the period we announced.
We keep improving Mia. If we remove or limit an important feature of your plan, we tell you in advance and, if you are a consumer, you can end the contract at no cost, as OUG 141/2021 provides.
9. What you do as the seller
Because you are the seller, you answer to your buyers. In particular:
- Inform accurately. Your page shows your name or business name, your contact details and, where relevant, your tax ID and VAT status. Describe each product exactly, with the final price and what the buyer gets.
- Deliver what you promised, on time, and answer buyers' questions.
- Respect consumer rights: the 14-day right of withdrawal and the legal guarantee of conformity. For digital content, courses and bundles, Mia's checkout requires the buyer to tick an express request for immediate access and an acknowledgement that the right of withdrawal ends once delivery starts; after delivery starts, you owe no withdrawal refund for those products. Memberships and installment plans keep the 14-day right. You pay refunds, from your Stripe balance. Your own policy can be more generous than the law, never stricter.
- Handle your taxes and invoices. You issue the invoice to the buyer, you decide whether and how much VAT applies, and you declare your income. Mia does not give tax advice. Check your settings with your accountant.
- Have the right to sell what you sell: copyright, licences and, for regulated professions (psychotherapy, medical, legal or financial advice), the authorisation the law requires.
- Respect your buyers' data. You are the controller of their data. You need a legal basis for the emails you send, you give buyers a privacy notice, and you get their consent for any ad pixels you add.
- Follow the [Acceptable Use Policy](/en/acceptable-use), Stripe's rules, and Meta's rules if you connect Instagram.
10. Payments through Stripe
To get paid, you open a Stripe connected account through Mia. The contract for that account is between you and Stripe and includes the Stripe Connected Account Agreement. Stripe verifies your identity and pays out to your bank account.
- Mia takes no commission on sales (0% Mia fee). You pay Stripe processing fees directly to Stripe and see them in your Stripe account.
- Refunds, chargebacks and their fees come out of your Stripe balance.
- We may temporarily limit sales on your page, through Stripe settings, only in the cases in section 16 and with a statement of reasons.
11. Automatic invoicing from your account
If you connect your invoicing tool (for example Oblio), you authorise us to send each paid order to that tool, so the invoice is issued in your name and from your account, with your series and VAT settings. On a full refund we can also request a credit note, if you turn that option on.
You remain the issuer of the invoice and answer for its content and your e-Factura obligations. Mia only triggers it. You can withdraw this authorisation any time by disconnecting the tool.
12. DAC7 reporting
As a platform operator, we must report certain sales made through Mia to the Romanian tax authority (ANAF), under Directive (EU) 2021/514 (DAC7) as transposed into the Romanian Tax Procedure Code. This covers, for example, personal services: coaching sessions, consultations, lessons or other services performed by individuals, online or in person.
If you sell such services, we ask for the identification details the law requires (name, address, tax ID, date of birth for individuals, bank account) and report them by 31 January for the previous year. You get a copy too. If you don't give us the details after several reminders, we may restrict sales of reportable services until you complete them.
13. Your content and the licence you give us
The content you put on Mia (text, images, files, courses, video) stays yours.
You give us a non-exclusive, free, worldwide licence, only as far as we need it to provide the service: to host it, copy it technically, display it, adapt its format (for example thumbnails or mobile video versions) and deliver it to your buyers. The licence ends when you delete the content or your account, except for copies buyers already received and temporary backup copies.
We show your name and page as an example in Mia materials only with your permission.
14. Your buyers' data: the data processing agreement
For the data of your buyers, subscribers and page visitors, you are the controller and Mia is the processor (Article 28 of Regulation (EU) 2016/679, the GDPR). This section is our data processing agreement.
| Item | What we agree |
|---|---|
| Subject and duration | Hosting your page, checkout, delivery, emails, bookings, courses and statistics, for as long as you have a Mia account. |
| Data | Name, email, order and billing details, messages, form answers, course progress, technical data about visits. |
| Data subjects | Your buyers, subscribers and page visitors. |
As processor, we commit:
- to process the data only on your instructions, meaning the way you use and set up Mia, unless the law requires otherwise (then we tell you, if the law allows);
- that our people with access to the data are bound by confidentiality;
- to apply appropriate security measures (Article 32 GDPR), described in the Privacy Policy;
- to use only the sub-processors listed in the Privacy Policy, under contracts that impose the same duties on them. You give us general authorisation to use them. We tell you at least 30 days before adding a new one, and if you have a reasonable ground to object, you can close your account at no cost;
- to help you answer buyer requests (access, deletion, export), including through the tools in your dashboard;
- to tell you without undue delay if we learn of a personal data breach affecting your buyers, and to help you with the notifications;
- when your account closes, to give you 90 days to export, then delete the data, except what the law requires us to keep;
- to give you the information you need to check that we meet these duties, and to answer reasonable audit questions.
For a few purposes we are an independent controller, not a processor: preventing fraud and abuse, payment security, our own legal obligations (DSA, DAC7, tax) and aggregated statistics about the platform.
15. The AI assistant
The AI assistant suggests text (descriptions, emails, ideas). Its results are suggestions. You review them before publishing and you answer for what you publish. We don't guarantee that generated text is accurate, original or fit for your purpose.
Don't use the assistant for prohibited content and don't enter sensitive data about other people. As far as we are concerned, the rights in text generated for you belong to you.
16. Moderation, restriction and suspension
We don't check every product in advance, but we act when we learn of content that is illegal or breaks the Acceptable Use Policy. Anyone can report illegal content to dsa@mia.store.
The steps, lightest first: we ask you to change something; we hide a product or your page; we temporarily suspend your account or your ability to sell; we close your account. We choose the step that fits the problem. A person makes the decision; automated tools only flag.
- When we restrict or suspend something, we email you a statement of reasons, at the latest when the decision takes effect: what we decided, on which facts, which rule was broken and how to appeal.
- If we want to close your creator account for good, we tell you at least 30 days in advance, with reasons. We close without notice only if the law requires it, if you repeatedly broke these terms, or in cases of illegal content, fraud or serious risk to buyers or the platform. We still send you the reasons.
- If you clear things up, we lift the restriction without delay.
We report to the authorities any case where we suspect a criminal offence that threatens someone's life or safety.
17. Complaints and appeals
If you disagree with one of our decisions or have a problem with Mia, write to support@mia.store within 6 months of the decision. It's free. Someone on the team reviews it again, where possible not the person who first decided, and replies in writing as soon as possible.
As a small enterprise, we are not legally required to run an internal complaint system or to name mediators for business users (Articles 11(5) and 12(7) of Regulation (EU) 2019/1150; Article 19 of Regulation (EU) 2022/2065). We offer it anyway and are open to mediation in good faith.
If you are a consumer, you can also contact the Romanian consumer authority ANPC (anpc.ro) or its alternative dispute resolution service (reclamatiisal.anpc.ro).
18. Transparency for creators
- Order on your page. Mia has no shared catalogue where we rank creators. You choose the order of products on your page. If we ever add search or recommendations across creators, we will describe the main criteria here.
- Equal treatment. We have no products of our own competing with yours and we don't favour particular creators. Differences between creators come only from the plan chosen (Start or Pro), described on the pricing page.
- Access to data. You can see and export your orders, customers, subscribers and page statistics from your dashboard. We use this data only to provide the service, for security and for aggregated statistics. We don't sell it and don't give it to other creators.
- Other channels. We don't promote your products on other sites or networks without your permission.
19. Service availability
We do everything in our power to keep Mia running without interruption, but there may be planned maintenance, faults or problems at our providers. We announce major maintenance in advance when we can. Keep a copy of your important content; you can export it any time.
20. Mia's rights
The platform, code, design, the Mia name and logo belong to Craftworks Labs S.R.L. We give you the right to use Mia while you have an account, under these terms. You may not copy, decompile or resell the platform.
If you send us ideas or suggestions, we may use them for free, with no obligation to you.
21. Liability
We are liable without limit for harm caused intentionally or through gross negligence and for injury to life or health. Nothing in these terms limits the rights you have as a consumer where the law does not allow them to be limited.
Otherwise, if you use Mia as a professional (PFA, company or other business activity):
- we are not liable for lost profit, lost sales, data you could have saved by exporting, or indirect loss;
- our total liability in any one year is limited to the amount you paid for your Mia subscription in the 12 months before the event.
We are not liable for creators' products, for the relationship between creator and buyer, or for services of Stripe, Meta or other third parties, except to the extent we were at fault.
If a buyer or an authority claims compensation from us because of your products, your content or your breach of these terms, as a professional you indemnify us for the reasonable costs, including legal costs.
22. Closing your account
You can close your account any time in settings or by writing to us. Your subscription stops at the end of the paid period.
After closing, or if the subscription is unpaid, your page is paused. You have 90 days to export your data; then we delete it, except what the law requires us to keep (for example accounting records, 10 years). Buyers who already bought access to a product must be able to keep using it for as long as the seller promised; let them know before you close.
The sections on the licence, data processing, liability and governing law continue after closing, as long as needed.
23. Changes to these terms
We may update these terms when the service or the law changes. For important changes we notify you by email and in the app at least 30 days before they take effect (at least 15 days, as the law requires for business users). If you don't agree, you can close your account before then, at no cost.
We may apply a change sooner only if the law or an authority requires it, or to address an unforeseen risk of fraud, security or harm to buyers. The version and date of the last update are always at the top of this page.
24. Governing law and disputes
These terms are governed by Romanian law. We first try to settle any disagreement amicably; just write to us.
If that fails, disputes go to the competent courts in Romania. If you are a consumer, you keep the protection of the law of the country where you live and may bring a claim there, as the law allows.
25. Other provisions
- If a provision is found invalid, the rest of these terms stay in force.
- If we don't use a right straight away, that doesn't mean we waive it.
- We may transfer this contract to another company only together with the Mia service and with prior notice. If you are a consumer, the transfer doesn't reduce your rights.
- You can write to us at support@mia.store. We write to the email address on your account. Our emails are communications on a durable medium.
